In India, trademarks have a 10-year lifespan and can be extended indefinitely. The Registrar gives a six-month window to do so, starting from six months before the expiration date. In case Trademark is not renewed during that period, trademark owner can receive an expiry notice to the registered address before the six months are up. If renewal is not filed, the Registrar will publish an announcement in the Trademarks Journal stating that the trademark will be removed. However, this is unlikely to occur until 12 months after the expiration date. Through a procedure known as restoration, trademark registration can be renewed between 6 and 12 months after it expires.
Trademark renewal must be filed prior to the mark’s expiration date. To enjoy continuous trademark rights without the risk of litigation, the trademark renewal application form must be prepared and filed before the deadline. In India, trade marks may be renewed indefinitely as long as the renewal fees is paid on time.
